Arthur William Hite, a California state prisoner, appeals pro se the district court's denial of his habeas corpus petition that seeks relief on the grounds that 1) the prosecutor improperly commented on Hite's post-arrest silence during trial; 2) the trial court erred in sustaining a hearsay objection to testimony regarding Hite's conversation with a police officer which was offered by Hite to explain his silence; and 3) Hite was denied effective assistance of trial counsel because his attorney failed to investigate the facts surrounding a prior burglary conviction used to enhance Hite's sentence. Hite is not entitled to relief on the first or second grounds, but we remand for an evidentiary hearing on his ineffective assistance claim.
