After a trial, Diallo Davidson was convicted of unlawfully possessing a firearm as a previously convicted felon, in violation of 18 U.S.C. Â§ 922(g)(1). On appeal, he argues that the district court erred in admitting certain testimony and in permitting the government to exercise its peremptory challenges to exclude two African-American jurors. He also argues that his sentence was erroneously imposed under the mandatory sentencing guidelines system that prevailed prior to United States v. Booker, 543 U.S. 220 (2005). We affirm his conviction, but vacate his sentence and remand for resentencing.
